Terms & Conditions

PLEASE READ CAREFULLY 

 

AGREEMENT: All bookings are made with Ibn Jubayr Tours, LLC ("IJT"), a Virginia limited liability company (“IJT,” “we,” or “us”). By booking a tour with us, paying a deposit or signing this agreement, you accept all of the terms in this agreement on your own behalf and on behalf of all persons listed on the booking, including any traveler under the age of 18 under your custody, care or control (“Minor”) (also referred to individually as “Traveler,” and collectively as “Travelers”), and direct us to perform services for each and every Traveler. The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you the Traveler (“you” or “your”) and IJT with respect to any and all bookings, reservations, tours, or transactions made with IJT.

 

RESERVATIONS:  A non-refundable deposit of $150 is required to hold your reservation. The balance of the tour cost is due and must be received by IJT no later than the relevant tour registration deadline as found on the Tour page.  Payment can be made by credit card, Venmo, Zelle or Bank Wire. We use a third party payment gateway to process credit card payments. Prices do not include international airfare. You do not need to have your flight booked in order to put a deposit down. However, we suggest you consult us prior to booking your flights. After full payment is received and prior to the tour dates, we will send you a packet of information outlining what to bring and additional information to prepare you for your visit to your destination.  

 

CANCELLATION POLICY  

Cancellations by You: IJT works with quality vendors, instructors, and guides to provide you with a unique tour. In order to best serve all our guests and provide high quality services IJT has a firm cancellation policy. There are no refunds in the event that you need to cancel your trip.   There are no exceptions to this policy. We strongly encourage and recommend that you obtain trip interruption/cancellation insurance to protect yourself in the event that you must cancel your tour for any reason. This insurance can be purchased from various travel insurance companies. 

 

Cancellations by IJT: We use employ our best efforts to maintain our standard of never canceling a tour, but we reserve the right to cancel a tour if the minimum group size has not been reached by the registration deadline. However, we will not cancel a tour on this basis if we have previously informed you that the tour has reached the minimum requirement and you should purchase airline tickets.  In rare circumstances, events outside the control of IJT may require that a tour be cancelled. If we cancel a tour, all deposits and payments made to date will be refunded in full.  

 

Because we strongly recommend that you obtain trip cancellation insurance and because you have notice of this cancellation policy, IJT is not responsible for any additional personal travel expenses you may incur in connection with cancelled tours including airline tickets

 

CREDIT CARD CHARGEBACKS

Before initiating a chargeback related to any supplier of service, you agree to first attempt to resolve directly any disputed transaction fees with us. You agree to indemnify, hold harmless and defend IJT against airline debit memos for credit card chargebacks arising out of: (a) your complaints regarding an airline service or (b) unauthorized charges by members of your family or former employees of your company. You also agree to refrain from initiating a chargeback dispute for any other reason except fraud. You further agree to pay IJT’s reasonable attorney fees and expenses if IJT has to file suit against you in order to enforce the indemnification provision under this paragraph or if you initiate a chargeback dispute arising out of a cause other than fraud.

 

 

CHANGES TO YOUR TOUR 

Changes by you: IJT does not and will not accept changes, including changes of dates, from you to the tour itinerary that you have booked and made a deposit or additional payments towards. For this reason, we strongly recommend purchasing travel insurance to protect against events that would affect your ability to participate. However, if possible and subject to our sole discretion, we may assist participants on a case-by-case basis if you are forced to request a change. In that event, a change fee may be charged. 

 

Changes by IJT: In the rare event that it becomes necessary for IJT to modify the tour itinerary due to events, conditions or hazards outside of our control, then we reserve the right to do so. When the conditions are those that permit us to modify but not cancel a tour, then we will attempt to add other activities to replace those omitted. Because you can protect your financial investment by purchasing travel insurance that covers changes and cancellations for a variety of causes and because of our relationships with our guides, hotels, etc., we do not provide full or partial refunds for changes due to any cause whatsoever that is outside the control of IJT. 

 

THE FOLLOWING SECTION APPLIES ONLY TO CALIFORNIA, HAWAII, ILLINOIS AND WASHINGTON RESIDENTS: Upon cancellation of any services, where the Traveler is not at fault and has not canceled in violation of any provision of these Terms and Conditions previously clearly and conspicuously disclosed and agreed to by the Traveler, all sums paid to IJT for services not provided will be promptly paid to the Traveler. In California, Hawaii, Illinois and Washington, this provision does not apply where the IJT has remitted the payment to another vendor or supplier, without obtaining a refund, and where the vendor or supplier defaults in providing the agreed-upon transportation or service. In this situation, IJT must provide the Traveler with a written statement accompanied by bank records establishing the disbursement of the payment to the vendor or supplier.

 

TRAVEL AND ENTRY DOCUMENTS: All U.S. citizens need a valid U.S. passport to travel in and out of the U.S. Your passport MUST have at least 6 months remaining effective the trip end date before expiration to be considered valid. Please check with your airline or travel agent if you have additional questions regarding necessary documentation both for you and for minors. These requirements can change without notice. Parents traveling with children and/or infants are advised to travel with identification and proof of citizenship for each child. If crossing an international border when both parents are not present, the traveling parent may be required to provide a signed and certified statement from the other parent allowing the child to travel out of the country. Failure to provide such evidence may prevent entry into that country.  

Please be advised that in many of the destinations in which we operate tours a valid visa is required for U.S. citizens to enter the country. Travelers assume full responsibility for complying with passport, visa, vaccination or other entry requirements. You also assume full responsibility for securing or protecting your baggage or personal belongings at all times during the tour. 

 

TRAVEL AND MEDICAL INSURANCE: We strongly recommend that all of our participants obtain trip cancellation and interruption insurance to protect their investment in travel. Refunds cannot be made to you if do not or cannot participate in or complete the tour for any reason at all. By choosing to travel to your destination, you are accepting these risks, and the fact that insurance coverage is limited. IJT cannot be responsible for any costs that arise that would normally be covered by insurance. 

 

COOPERATION, CONDUCT, REMOVAL: As a tour participant, you acknowledge that the group endeavor requires compromise to accommodate the personal desires, capabilities and objectives of other travelers. You agree to act at all times in an appropriate social manner with the other participants and to act in a considerate and respectful manner in accordance with the customs of all places visited. During the course of the tour, we require that you comply with all local laws, respect local customs and culture, accurately assess your abilities. To facilitate a family friendly environment, IJT trips are alcohol, smoking and vaping free. The IJT representative has the right in his or her sole discretion to remove anyone (i) who he or she judges to be incapable of meeting the demands and requirements of participating in tour activities; or (ii) who he or she determines threaten the safety or detracts from others’ enjoyment of the tour. If you are unable to participate in a portion of or all of a tour for reasons covered by this paragraph, we will not offer a refund. 

 

FORCE MAJEURE:  IJT will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including, but not limited to, acts of nature, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances. Government actions which further restrict travel to or in and around your destination by either the U.S. or a foreign government are also Force Majeure events. If IJT and/or any of its suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement in relation to the tour.  

 

COMPLAINT PROCEDURE: If you have a complaint during your tour, you must promptly notify IJT or your tour leader of the problem so that they can attempt to remedy the situation. Failure to do so while you are on the tour will extinguish or reduce your ability to claim compensation from IJT. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential damages. If you are not satisfied after using this notice procedure, you must submit your complaint in writing to IJT within fourteen (14) days of the tour’s end date. IJT will not consider accepting any liability for claims received after this period. 

 

DEPARTURE DATE: It is your responsibility to be ready to embark on the tour as specified in the itinerary. IJT is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures. The “Departure Date” is the first date of the tour you booked with us and does not include any earlier travel dates that you may have booked for air travel or other touring. 

 

PHOTOGRAPHIC IMAGE RELEASE: You grant us, as well as the guides on our tours and our third-party suppliers, a worldwide, royalty-free, perpetual license to use, re-use, distribute, display, create derivate works of, and reproduce any images, photos, or videos   that you provide to us (whether directly or through a photo sharing service) (collectively, “Your Images”) in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for any purpose, including to promote and publicize our travel products and services worldwide. You also acknowledge and agree that we or other parties, including, but not limited to, the guides on our tours, our third-party suppliers and other participants, may during your tour take or create images, photos, sound recordings, and videos in any format that contain or feature you or the Minor (collectively, “Trip Images of You”). These images may contain your or the Minor’s name, likeness, identity, photographic image, videographic image, or oral or recorded statements. You agree that we, the guides, and our third-party suppliers may use these Images for any purpose, including to promote and publicize our travel products and services, and you grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images without your prior inspection. If you prefer this your or your Minor’s likeness not be used, you must notify us in writing before your tour’s departure date.

 

Copyright in all photographs, video, and related materials created by you during your tour will belong to you upon creation, subject to the licenses stated herein.

 

PASSPORT, VISA AND IMMIGRATION REQUIREMENTS AND HEALTH FORMALITIES 

It is your responsibility to check and fulfill the passport, visa, health and immigration requirements applicable to your itinerary. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your own doctor as applicable. Requirements do change, and you must check the up to date position in good time before departure.

 

Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. For example, if traveling to or through Canada, Americans with a Driving While Intoxicated (DWI) or possession of marijuana record should always check whether current rules exclude admission, and potential waivers. It is Customer’s responsibility to verify that all the visas required for your trip have been obtained, that the visas for each country are valid for the entry and exit dates of your visit, that your personal details are accurately reflected. Please note that even when a visa is issued, a traveler may be denied entry since each country’s local immigration officials make the final entry decision. Several factors including past criminal record may contribute to the decision of the local immigration official(s). Should a visa not be issued, IJT is not responsible for lost payments made toward the contemplated trip.  If you call our office, our representatives do not make this inquiry because we feel it is an invasion of privacy. 

In the case of Iran, IJT assists with obtaining visas by submitting visa applications to an authorized tour agency in Iran which works directly with their government to obtain the visa approval. In the event your visa is not approved by the government of Iran, you will be granted a package refund minus a $150 visa processing fee. However, this is contingent on the traveler submitting required information in a timely manner including answering any follow up questions posed by the Ministry of Tourism.

For medical information about your destination, we recommend contacting the Centers for Disease Control at (877) FYI-TRIP or go to http://www.cdc.gov/travel. We do not accept any responsibility if you cannot travel or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities. You agree to reimburse us in relation to any fines or other losses which we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities.

 

HAZARDOUS MATERIALS

USA federal law prohibits passengers from bringing hazardous materials on the aircraft. (1) USA federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. (2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant air line representative(s) on their itinerary. INSECTICIDE NOTICE

All passengers are referred to always check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the DOT’s website, as this list is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements

 

SUPPLIER CONTRACTS AND AIR TRANSPORT RULES

Many of the services which make up your trip are provided by independent suppliers. Those suppliers provide these services in accordance with their own consumer contracts covering cancellation penalties, supplier loyalty rewards programs and a wide range of other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. Some of these terms and conditions may limit or exclude the supplier's liability to you. Copies of the relevant parts of these terms and conditions are available on the supplier’s website or upon request from the supplier concerned. Upon request and to the extent we can honor your request, we will try to assist you in obtaining such supplier terms and conditions.

 

All airline Contracts of Carriage are available for view publicly on their websites and at their office branches.  Airlines regularly update the non-stop flights that they offer and as a result, IJT’s route network may also change without prior notice given to you.  IJT is not responsible for losses due to cancelled flights, seats, or changed flight Itineraries.  Suppliers retain the right to adjust flight times and schedules at any time; schedule changes can result in an Itinerary that falls outside of the desired travel window or may result in a non-stop Itinerary being changed to a connecting Itinerary with the same origin and destination airports.   You cannot cancel your reservation without penalty due to a change of schedule, aircraft type or operating carrier, unless the airline's policies permit penalty-free cancellations under such circumstances.  If an airline cancels or delays a flight, you should work with the airline to ensure you arrive at your destination.  IJT will not provide any refund of costs incurred by you, in part or full, due to missed, cancelled or delayed flights, or other flight irregularities including, without limitation, denied boarding whether or not you are responsible for such denial.  Airline flights may be overbooked. A person denied boarding on a flight may be entitled to a compensatory payment or other benefits from the airline.  The rules for denied boarding are available at all ticket counters and within the airline’s Contract of Carriage. E-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.

 

AIR CHECK-INS, DELAYS, MISSED FLIGHTS, IDENTITY OF THE CARRIERS AND DENIAL OF BOARDING

Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights. Failure to use a reservation may result in automatic cancelation of all continuing and return flights, as well as forfeiture of airfares. If you or any member of your party miss your flight or other transport arrangement, it is canceled, or you are subject to a delay of over 3 hours for any reason, please contact us and the airline or other transport supplier concerned immediately.

 

Under European Union (EU) law, for flights by EU airlines, or for flights by other airlines departing from a point in the EU, you have rights in some circumstances to refunds and/or compensation from the airline in cases of denied boarding, cancellation or delay to flights. Full details of these rights will be publicized at EU airports and will also be available from airlines. Reimbursement in such cases is the responsibility of the airline and will not automatically entitle you to a refund of your trip price from us. A delay or cancellation to your flight does not automatically entitle you to cancel any other arrangements even where those arrangements have been made in conjunction with your flight.

 

The carrier(s), flight timings and types of aircraft shown in this brochure or on our website and detailed on your confirmation invoice are for guidance only and are subject to alteration and confirmation. If the name of the carrier(s) do not appear on your confirmation invoice or if a carrier is replaced, we will inform you of the identity of the actual carrier(s) as soon as we become aware of it. The latest flight timings will be shown on your tickets which will be sent to you approximately two weeks before departure. You should check your tickets very carefully immediately on receipt to ensure you have the correct flight times. If flight times change after tickets have been sent, we will contact you as soon as we can to let you know.

 

IJT DOES NOT ACCEPT ANY RESPONSIBILITY IF YOU ARE DENIED BOARDING ON AN AIRCRAFT OR ENTRY INTO A SECURE SECTION OF AN AIRPORT DUE TO THE FAILURE ON YOUR PART TO CARRY OR OBTAIN THE CORRECT DOCUMENTATION OR IDENTIFICATION OR FOR ANY OTHER REASON.  IF YOUR FAILURE TO DO SO RESULTS IN FINES, SURCHARGES, CLAIMS, FINANCIAL DEMANDS OR OTHER FINANCIAL PENALTIES BEING IMPOSED ON IJT, YOU WILL BE RESPONSIBLE FOR INDEMNIFYING AND REIMBURSING US ACCORDINGLY, WITH CHARGES AUTOMATICALLY BEING MADE TO YOUR CREDIT CARD ON FILE.

 

ADVANCE PASSENGER INFORMATION 

A number of Governments are introducing new requirements for air carriers to provide personal information about all travelers on their aircraft to authorities before the aircraft departs. The data will be collected either at the airport when you check in or in some circumstances when, or after you make your booking. Accordingly, you are advised to allow extra time to check in for your flight. Where we collect this data, we will treat it in accordance with our privacy policy.

 

RESERVATION INFORMATION AND IDENTIFICATION DOCUMENTATION REQUIREMENTS.   

When making a travel reservation with IJT you agree to (i) provide accurate, current and complete information about yourself and those persons on whose behalf you are making a booking (hereinafter referred to as “Booking Data“); (ii) maintain and promptly update IJT as to any changes to the Booking Data, and any other information provided to IJT, in order to keep it accurate, current and complete; and (iii) accept all risk of unauthorized access to any information you provide to IJT, (including, but not limited to Booking Data).  IJT may need to request documented proof of identity in order to make certain changes to Booking Data, such as changes to name or birth date.

 

IJT is not obligated to retain a record of Traveler’s account or any Booking Data or other information that you may have stored by means of your client file for your use of the Service, but may decide to do so at its own discretion as business decisions may warrant.   You are only authorized to create and use one account with IJT and the account must be in the proper legal name of yourself and the persons for whom you are reserving tickets, as you are prohibited from using alter egos or other disguised identities when using the Service.   All airline tickets and other travel documents will be issued in the name(s) of the passenger(s) listed in your Booking Data and once issued may not be available for a name change.  

 

COOPERATION WITH LAW ENFORCEMENT

We reserve the right to fully cooperate with any law enforcement authorities or court order requesting disclosure of the identity of anyone posting any e-mail messages, or publishing or otherwise making available any materials that are believed to violate these Terms and Conditions. BY ACCEPTING THIS AGREEMENT, YOU WAIVE AND HOLD HARMLESS IJT FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY IJT DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER IJT OR LAW ENFORCEMENT AUTHORITIES.

 

TSA SECURE FLIGHT

Please be advised that the Transportation Security Administration (TSA) requires airline passengers to carry a government issued ID in order to board a flight. The name, date of birth and gender that appears on the ID must exactly match the same such data that is listed on your airline ticket and in your booking records. Failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint which could cause you to miss your flight.

 

REAL ID 

Please be advised that beginning May 7, 2025 a state-issued ID or license may only be used to pass through airport security checkpoints and to subsequently board a flight within the United States if it is REAL ID compliant. State issued temporary driver's licenses, hunting, firearms or weapons permits are not acceptable forms of identification. Please contact your state department of motor vehicles if you are unsure whether your ID complies with the REAL ID Act.

 

CHILDREN 

TSA does not require children under 18 to provide identification when traveling with a companion within the United States. However, airline policies regarding ID requirements for minors may differ from TSA rules. Please contact the airline(s) shown on your itinerary to inquire about any airline-specific ID requirements for travelers under 18.

 

LIMITATION OF LIABILITY, INDEMNIFICATION: YOU AGREE THAT THE SOLE REMEDY FOR ANY DEFAULT BY IJT ARISING UNDER THE TERMS SHALL BE THE RETURN OF THE PAID TOUR COST. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IJT WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING FOR PERSONAL INJURY) REGARDLESS OF THE FORM OF THE ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF IJT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND YOU EXPRESSLY WAIVE ANY RIGHT YOU MAY HAVE TO RECOVER SUCH DAMAGES. YOU AGREE TO DEFEND AND INDEMNIFY IJT AGAINST ANY CLAIM BY ANY PERSON THAT ARISES IN WHOLE OR IN PART FROM AN INJURY OR OTHER LOSS SUFFERED OR CAUSED BY YOU IN CONNECTION WITH THE TOUR. 

 

GOVERNING LAW, FORUM: This Agreement will be interpreted according to the laws of the Commonwealth of Virginia in the United States. You agree to make good faith attempts to resolve any disputes that may arise from this agreement first through various forms of alternative dispute resolution, including, but not limited to, amicable negotiations, mediation, or arbitration in the Commonwealth of Virginia. If good faith efforts of alternative resolution fail, jurisdiction over any dispute arising out of, in connection with, or relating to this agreement and/or the transactions and relationships among the parties contemplated by this agreement shall be filed exclusively in federal or state court in Fairfax County, Virginia. You agree to personal jurisdiction in the specified forum. In the event any action or proceeding is initiated by you in a court outside of Fairfax County, Virginia, you agree to pay IJT's costs and reasonable attorney fees associated with defending such action or proceeding. You agree to bring any action against IJT arising from this agreement within two years from the date of the signature of this agreement. 

 

SEVERABILITY AND SUCCESSORS AND ASSIGNS: If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision. This agreement shall inure to the benefit of, and be binding upon, you and IJT and your respective heirs, legal and personal representatives, successors and assigns.

 

AMENDMENT: These Terms and Conditions may not be amended, altered or modified, except by a written amendment executed by an authorized representative of IJT. IJT reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these Terms and Conditions. The most up-to-date version of these Terms and Conditions can be found on IJT’s website at www.ijtours.com. 

 

CONTRACT CONSTRUCTION: No provision of this Agreement shall be construed against or in favor of a party merely because of who drafted it. 

 

FINAL AGREEMENT: This agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous discussions, negotiations and agreements. By signing this, you acknowledge that you have read this entire agreement, and you are signing it freely. You understand that this is a legally binding contract. No other representations concerning the legal effect of this document have been made to you. Your signature applies to all pages of this agreement.   

 

 

If Traveler is a Minor, a Parent or Guardian’s signature is required (if applicable/)

By signing, you represent and warrant that you are the parent or legal guardian of the Minor and have the full authority to bind the Minor to this agreement, that you are 18 years or older, and that all information that you have submitted with this agreement is truthful and accurate. You agree that you are signing on behalf of yourself and your spouse, partner, or any other person who is a legal guardian of the Minor (referred to both individually and collectively as “Parent”) and that you have the Parent’s authority to do so. You agree that this agreement is made on the Minor’s behalf and that the terms of this agreement, to the maximum extent permitted by law, are binding on the Minor, you and any other Parent on whose behalf you are signing. You further agree that if this agreement is, for any reason, found to be unenforceable with regard to the Minor, that you will personally indemnify  and hold IJT harmless against any claim which may be brought against IJT, whether by a Parent acting as guardian ad litem or by the Minor directly as an independently named claimant. Your signature applies to all pages of this agreement.
